Terms of Service

By using the Kweri service (the "Service"), you agree to these terms. If you disagree with any part, do not use the Service.

1. Service description

Kweri is a tool for SEO specialists: keyword position tracking in Google and Yandex, keyword clustering, SERP analysis, data export.

2. Registration and account

• Email registration is required to use the Service
• You must provide a valid email address
• You are responsible for password security and account actions
• Minimum age: 16 (or your country's age of digital consent)
• One person = one account (multiple accounts prohibited)

3. Free usage

The Service is currently provided free of charge. We reserve the right to introduce paid plans in the future — with at least 30 days notice. Existing users will receive a grace period.

4. Acceptable use

Prohibited:

• Using the Service for illegal purposes
• Automated scraping/parsing of our pages
• Hacking attempts, security circumvention, exploiting vulnerabilities
• Creating excessive load (DDoS, brute-force, spam registrations)
• Sharing credentials with third parties
• Uploading keywords with prohibited content (drugs, extremism, copyright infringement, etc.)

Violations may result in account suspension without refund (if any).

5. User content

All keywords, projects, clusters — are your content. We don't claim rights to it and don't use it for our purposes.

However, you grant us a limited license to store and process this content for the purpose of providing the Service.

6. Third-party APIs

The Service uses XMLRiver API for Google/Yandex SERP data. You must have a valid XMLRiver account and pay according to their pricing. XMLRiver costs are your responsibility.

7. Limitation of liability

The Service is provided "AS IS" without warranties of any kind. We are not liable for:

• Accuracy of data from search engines (we receive it via XMLRiver)
• Temporary unavailability of the Service
• Data loss due to force majeure
• Indirect damages (lost profits, etc.)

Our maximum liability is limited to the amount you paid us in the last 12 months. For free users — zero.

This limitation does not apply to intent, gross negligence, or where prohibited by mandatory law (e.g. § 309 BGB).

8. Termination

You can delete your account at any time via profile settings. Upon deletion, we will remove all your data per the Privacy Policy (up to 30 days for guaranteed removal from backups).

We may suspend or terminate your account for material breach of these terms, with notice if possible.

9. Changes to terms

We may update these terms. Material changes will be notified via email or in-app banner at least 14 days before taking effect. Continued use after changes = acceptance.

10. Governing law and jurisdiction

Governing law: [GERMANY / Federal Republic of Germany]. All disputes subject to courts of [CITY], Germany.

For EU consumers: you may bring proceedings in the courts of your country of residence per EU Regulation 1215/2012 (Brussels I).
